Nearly a year after Charlie Kirk was shot and killed at a Utah college event, the man accused of his murder could learn whether he will stand trial — and potentially face the death penalty.
A Utah judge is set to determine on Tuesday, September 1 whether prosecutors have presented enough evidence to send Tyler Robinson to trial for Charlie’s killing, according to a New York Post report published that same day.
The hearing is scheduled for the morning in Provo, Utah, where Judge Tony Graf will weigh up to four hours of closing arguments before deciding whether probable cause exists to move the case forward, per the outlet. Should he rule in prosecutors’ favor, Robinson, 23, could be formally arraigned soon after, a Utah courts spokesperson said, according to the report. He has not entered a plea.
Prosecutors allege the former electrical apprentice fired the shot that killed Charlie, 31, while the Turning Point USA cofounder was speaking with students at Utah Valley University on September 10, 2025, per the report.

The case returned to court following a preliminary hearing in July, when prosecutors laid out what they called “overwhelming” evidence, including forensic test results prosecutors say tie Robinson’s DNA to the murder weapon, the New York Post reported.
According to the outlet, Robinson faces a charge of aggravated murder, with prosecutors contending the shooting also put other event attendees in danger — a factor that opens the door to capital punishment under Utah law. His defense team rejects that framing, arguing the case doesn’t rise to a capital offense since Robinson struck his “intended target” without threatening anyone else in the crowd, per the report.

Prosecutors have further argued Robinson’s motive was rooted in Charlie’s opposition to transgender rights and gay marriage, a claim that could strengthen their push for the death penalty. Defense attorneys counter that nothing shows Robinson took issue with Charlie’s politics at all, per the report.
Erika Kirk, who stepped into the role of Turning Point USA’s CEO and board chair after her husband’s death, sat through the July hearing and publicly forgave her husband’s alleged killer during a memorial service but has stayed silent on whether he should face execution, according to the report.
