A woman in Indiana who was previously accused of abusing underage students while she was a substitute teacher is now officially divorced from her husband.

In September of 2025, Brittany Fortinberry was hit with charges of sexual misconduct with a minor, dissemination of material harmful to minors and contributing to the delinquency of a minor. The charges link back to her allegedly having inappropriate relations with middle school boys that she would frequently have over to her house. She is accused of supplying them with alcohol and psychedelic mushrooms before assaulting them. In total, she faces 47 charges.

According to a report from TMZ published on Thursday, August 27, the 33-year-old and her husband, Nicholas Fortinberry, finalized their divorce Monday. Per the report, the former couple’s settlement awards Brittany her clothes, shoes and makeup. He gets two cars, a 2022 Chrysler Pacifica and a Toyota 4Runner.

The duo previously sold off the home they shared before the split proceedings began, which was around the same time charges were brought against her last year. The money from that sale was reportedly split down the middle. As for their child, Nicholas will have sole custody while Brittany fights the charges against her. She will regain legal custody following her release from jail if she’s found innocent.

The couple had been married since 2020.

In a September 2025 report from WTHR, Brittany is accused of having sexually assaulted multiple teen boys whom she would allow over to her home for drugs and alcohol. On one occasion, she is alleged to have organized a group sexual encounter in which she demanded the boys wear Ghostface masks popularized by the Scream horror movies. She allegedly told the teens that if they reported anything, she would end her own life.

The outlet notes that, prior to her 47 charges in this case, she was being investigated for a completely separate case in which she allegedly sent photos and videos of herself to 17 and 18-year-old boys who served as teachers’ assistants.
