Bill Cosby, who celebrated his 89th birthday over the weekend, is not in good health, according to his lawyer.

TMZ reported that the Cosby Show alum was scheduled to be deposed on June 23 and June 24 but could not attend.

While it is unclear why Cosby was to be deposed, the National Enquirer previously reported that he was ordered to pay more than $59 million in civil damages to a former waitress who accused him of attacking her in 1972.

On May 29, Los Angeles judge Bradley S. Phillips rejected Cosby’s motion for a new trial, at which he could defend himself against the former waitress, Donna Motsinger.

According to new legal documents obtained Tuesday, July 14, by TMZ, Cosby’s lawyer Jennifer Bonjean said the former actor could not proceed with his deposition due to his “disabilities, age-related health issues, and related logistical challenges that could not be avoided.”

Additionally, according to Cosby’s lawyer, he is “legally blind and suffers from a variety of health issues, including significant mobility limitations.”

Cosby “must be accompanied by a male assistant at all times to ensure his safety and to help with basic needs like using the restroom,” his lawyer stated in the legal docs, which stated that Cosby’s support was “not available on the scheduled days.”

The former comedian seemed to go off the grid after the court ordered the $60 million payment.

“Cosby’s whereabouts is absolutely essential to enforcement activities, and his mysterious disappearance after entry of a $60 million judgment and denial of post-trial motions is deeply concerning,” stated court docs filed by Motsinger, who sued him for the 1972 incident.

“Despite at least three attempts to serve Cosby at his usual abode, Cosby appears to be evading service,” the documents stated.
