Danny Masterson wants a new trial — and it’s got his ex-wife Bijou Phillips “panicking,” a source tells the National Enquirer.
In 2023, the That ‘70s Show star, 49, was sentenced to 30 years to life for raping two women, a punishment he is actively seeking to overturn.
Attorney Eric Multhaup shared a statement with the Los Angeles Times after filing a 183-page petition on Sunday, November 16, claiming that Masterson’s conviction was a result of “prosecutorial misconduct, judicial bias and the failure of defense counsel to present exculpatory evidence.”
The actor has issue with how the court of public opinion ruled on his case, too. “Danny hates how he’s been portrayed and abandoned by the family and friends he fully expected to stand by him,” says the source.

Phillips, 45, filed for divorce from Masterson in the months following his September sentencing. She also recently filed to legally change the last name of their 11-year-old daughter Fianna from Masterson to Phillips, per TMZ.
“Danny was appalled that she changed their daughter’s name,” the source says, “and he hates how she rarely, if ever, comes to visit anymore.”
Since their split, the Almost Famous actress has found love with boyfriend Jamie Mazur. She was first linked to the 44-year-old businessman in June of 2024 and went public with their relationship in January.
“Bijou has worked so hard to move on and rebuild her life,” says the source. “Having Danny come back to haunt her would be an unimaginable nightmare.”
